a note on what happened in california today…
So all the headlines read: California Supreme Court on Prop. 8’s Ban of Same-Sex Marriage.
And yes, that is mostly true, but not really accurate. Remember, this is the same Supreme Court who GRANTED same-sex couple the right to marry last year.
Then came a ballot initiative, Proposition 8. In California, a ballot initiative can be voted on by the public in order to CHANGE the state constitution. Prior to this, the Supreme Court judged that the existing state constitution should allow for same-sex couples to marry. When said constitution was changed, the Court’s hands are tied.
The case before the Supreme Court today argued that the Proposition was a “revision” and not an “amendment”. But the Court, as exepcted based on precedent, disagreed.
Outrage should be expressed at the ludicrously easy way to change the constitution of the state! And, of course, the despicable nature of the amendment itself.
The technicality of law is infuriating and often leads to results that are unsavory while not specifically ‘unjust’.
I may not have explained this very well, but I think my point was that the Supreme Court more or less upheld the PROCESS by which Proposition 8 was enacted. The language in which it was written took advantage of one of many legal loopholes through which people abuse the systam for selfish purposes.
Anyway, /rant. Just don’t hate on the Supreme Court too much. Don’t misdirect the anger from where it really belongs: the ignorant minds of 52% of the California voting populace and the bitter hearts of those that exploited them.
